Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your") and Bukza Pte. Ltd. ("Bukza", "we", "us", or "our"), a company registered in Singapore (UEN: 202441730M). These Terms apply to Business Users, End Users, and Visitors, as defined below.
By accessing, registering for, or using the Service, you agree to be bound by these Terms, the Privacy Policy and the Data Processing Agreement, which are incorporated by reference.
If you do not agree to these Terms, do not use the Service.
1. Scope of the Service
Bukza provides an online SaaS platform enabling Business Users to create and manage bookings for various resources (such as venues, items, group events, or staff appointments), and to allow their clients (End Users) to make reservations via embeddable web widgets or direct booking links. A separate mobile app is available exclusively for Business Users to manage their operations.
- Business Users: Registered businesses or authorized representatives with active Bukza accounts.
- End Users: Individuals booking resources via Bukza widgets, links, or apps, without creating an account with Bukza.
- Visitors: Anyone accessing Bukza's public-facing pages (e.g., documentation, home page).
2. Eligibility
- Business Users: Must be at least 18 years old and authorized to enter into contracts on behalf of their business or organization.
- End Users: Must be at least 16 years old, or have valid parental or guardian consent as required by applicable law.
- Visitors: Must not attempt unauthorized access to user or business data.
By registering or using the Service, you warrant that you meet these requirements.
3. Account Registration and Responsibilities
- Business Users must provide accurate and complete information when registering.
- You are responsible for maintaining the confidentiality of your credentials and all activity under your account.
- You must not impersonate any entity or use false information.
- Sharing credentials with unauthorized parties is prohibited.
- Business Users are responsible for all actions by personnel with access to their account.
4. End Users (Clients of Businesses)
- End Users do not create Bukza accounts but may submit personal data during booking.
- By booking, you authorize transmission of data to the relevant Business User.
- Data is processed in line with the Privacy Policy and any policies of the Business User.
5. Acceptable Use
You agree not to:
- Violate any laws or third-party rights.
- Use the Service for fraud, impersonation, or illegal purposes.
- Upload malware or malicious code.
- Collect sensitive personal data (e.g., health, religion, ID numbers).
- Disrupt or interfere with the platform.
- Attempt unauthorized access to systems or data.
Bukza reserves the right (but not the obligation) to monitor and review usage to ensure compliance with this section.
6. Payments and Billing
- Bukza may apply usage-based or subscription fees for access to the Service.
- All payments for Bukza's services are processed via Paddle.com, which acts as our Merchant of Record. Paddle handles invoicing, tax compliance (including VAT), and payment security on our behalf. For tax receipts or billing support, please contact Paddle directly at help@paddle.com.
- Prices exclude applicable taxes unless explicitly stated.
- Business Users may also integrate custom payment solutions using Bukza's Payments API. Each successful transaction processed via this API incurs a fixed fee, which is automatically deducted from the Business User's account balance. Business Users are solely responsible for their external payment systems and any data shared through them.
6.1 Refund Policy
- Refunds may be issued for technical issues confirmed by Bukza.
- All refund requests are reviewed case-by-case and granted at Bukza's discretion.
- Requests must be submitted to support@bukza.com within 30 days of the transaction.
7. Resource Booking, Widgets, and Third-Party Content
Business Users manage resources and booking flows via Bukza tools. Widgets may be embedded or linked externally. Bukza is not responsible for third-party sites or code embedded by Business Users.
Business Users are responsible for compliance with payment regulations when using their own Stripe or PayPal integrations.
If you use Payments API to integrate your own payment system, you must ensure that your server is secure and compliant with applicable laws. Bukza acts only as a technical relay for data exchange and is not responsible for the behavior or security of your external server.
Business Users may configure the Service to send booking data to external servers via web requests. Bukza acts only as a conduit and is not responsible for the destination or content of such transmissions.
8. Data Protection and Privacy
Your use of Bukza is subject to our Privacy Policy and the Data Processing Agreement. Bukza acts as processor for End User data and controller for Business User data.
9. Intellectual Property
The Service and its components are owned by Bukza or licensed. You are granted a limited license to use the Service for lawful business purposes during your subscription.
10. Termination and Suspension
Bukza may suspend or terminate your access at any time for violations. Upon termination, your rights end, and data may be deleted in line with retention policy.
You may terminate your use of the Service at any time by contacting support@bukza.com or by clicking the "Delete Account" button available in the application settings. This action will initiate the account closure process and deletion of associated data, subject to our data retention and backup policies.
11. Warranties and Disclaimers
The Service is provided "as is" and "as available." We disclaim warranties of fitness, merchantability, or uninterrupted use.
12. Limitation of Liability
Bukza is not liable for indirect or consequential damages. Total liability is limited to the amount paid by you in the past 12 months.
13. Indemnification
You agree to indemnify Bukza from claims related to:
- Your misuse of the Service;
- Your violations of law or these Terms;
- Data you or your users submit;
- Your business activity, disputes, or third-party services.
14. Changes to the Service and Terms
Bukza may update these Terms at any time. Material changes will be notified via email or within the platform. Continued use after changes means acceptance.
15. Governing Law and Dispute Resolution
These Terms are governed by Singapore law. You voluntarily and irrevocably consent to the exclusive jurisdiction of the courts of Singapore for any disputes.
16. Miscellaneous
- Entire Agreement: These Terms override prior agreements.
- Severability: Invalid terms do not affect the rest.
- Waiver: Failure to enforce a right is not a waiver.
- Assignment: You may not assign your rights; Bukza may do so freely.
- Force Majeure: We are not liable for delays due to causes beyond our control (natural disasters, wars, pandemics, etc.).

17. Language
These Terms are provided in English. In case of conflict between translations, the English version prevails.
